Specific project scopes, deliverables, and timelines will be outlined in individual service agreements or project proposals provided to the client.
2. Intellectual Property
- Site Content: All original content, code, graphics, and branding on this Site are the intellectual property of Rhetorical Designs.
- Client Projects: Ownership of final deliverables (e.g., a completed website) typically transfers to the client upon full payment of all project fees. Rhetorical Designs retains the right to display completed work in a professional portfolio or for marketing purposes unless otherwise agreed upon in writing.
3. Client Responsibilities
Clients are responsible for providing:
- Accurate project requirements and timely feedback.
- Necessary assets (logos, copy, images) for which they have the legal right to use.
- Access to hosting environments or third-party tools required for development (e.g., cPanel, WordPress admin).
4. Payments and Fees
- Quotes: All project quotes are valid for 30 days.
- Deposits: A non-refundable deposit (typically 50%) is required before project commencement.
- Final Payment: The remaining balance is due upon project completion and before the “go-live” phase or transfer of ownership.
5. Limitation of Liability
Rhetorical Designs provides services “as is” and makes no warranties regarding the absolute security or uninterrupted uptime of developed websites, as these are subject to third-party hosting and software updates. Rhetorical Designs is not liable for any indirect, incidental, or consequential damages resulting from the use of the services or the Site.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms will be subject to the jurisdiction of the courts in South Africa.
